1. Application basis:
（1）Law of the People's Republic of China on the Protection of Wildlife
- Article 10 The state protects wildlife by classification and grading
- Article 21 Hunting and killing national key protected wildlife are prohibited
- Article 27 The sale, purchase and utilization of national key protected wildlife and their products are prohibited
（2）Article 18 of Implementation Regulation of the People's Republic of Chinaon the Protection of Aquatic Wildlife
The sale, purchase of national key protected aquatic wildlife and their products are prohibited. The sale, purchase and utilization of national first-class protected aquatic wildlife and their products due to special occasions such as scientific research, domestication and breeding, exhibition shall be applied to the department of fishery administration of the people's governments of provinces, autonomous regions and municipalities directly under the central government and after they sign their opinions, they shall be submitted to the department of fishery administration under the State Council for approval. The sale, purchase and utilization of national second-class protected aquatic wildlife and their products shall applied to and approved by the department of fishery administration of the people's governments of provinces, autonomous regions and municipalities directly under the central government .
（3）Article 47 of Special Measures of Aquatic Wildlife Utilization of the People's Republic of China
The domestic administration of aquatic wildlife and their products in appendixⅠof CITES shall be implemented according to the administration provisions for national first-class protected aquatic wildlife in the Measure.
The domestic administration of aquatic wildlife and their products in appendixⅡ, Ⅲof CITES shall be implemented according to the administration provisions for national second-class protected aquatic wildlife in the Measure.
The administration of local key protected aquatic wildlife and their products shall be implemented according to the administration provisions for national second-class protected aquatic wildlife in the Measure.
2.Application dossiers:
① application form of special certificate of utilization
② certificate of the applicant's residence registration or business license of enterprise legal person and residence registration certificate of legal representative
③ certificate of ownership of business premises or lease agreement and lessor's ownership certificate
④ species introduction contract or agreement and lawful certificate of the provider
⑤ CITES Permit for Import & Export
3.Applicant(Generally it’s the actual business enterprise or person )
① natural person
② corporate enterprise
③ social organization legal person
④ institutional legal person
⑤ unincorporated enterprise
Tips: Importer, distributor and any interested parties involved in the business and utilization of the species all shall apply for the license
